These Terms of Use (“Terms”) govern your use of the mobile application “Backgammon Online” (the “Application”, “App”) and the website appfect.pro (the “Website”), operated by Anton Iliukhin, individual entrepreneur registered in Georgia (“Company”, “we”, “us”, “our”).
By installing, accessing or using the Application, you agree to be bound by these Terms. If you do not agree, do not install or use the Application.
1. EligibilityYou must be at least 13 years old to use the Application. By using the Application, you represent that you meet this requirement.
2. License and Use of the ApplicationWe grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms.
You agree not to:
  • copy, modify, distribute, sell, lease or reverse-engineer any part of the Application;
  • use the Application for any illegal or unauthorized purpose;
  • interfere with or disrupt the operation of the Application or servers.
3. Virtual Currency and In-App PurchasesThe Application may offer:
  • virtual coins or other in-game items;
  • subscriptions or other paid features.
Virtual items and currency:
  • are not real money and have no real-world value;
  • cannot be redeemed for real money or other real-world goods;
  • may be changed, limited or removed by us at any time.
All purchases within the Application are processed by the App Store provider (Apple). We do not control and are not responsible for any errors in payment processing on their side. Purchases are generally non-refundable, except as required by applicable law or the App Store refund rules.
4. User Account and Guest ModeWhen you first launch the Application, a guest account may be automatically created for you. You can later link this guest account to your Apple or Google account to synchronize your progress across devices.
You are responsible for:
  • maintaining the security of your device and account credentials;
  • all actions taken under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Fair Play and Prohibited BehaviorYou agree not to:
  • use cheats, bots, automation tools or any unauthorized third-party software;
  • exploit bugs or vulnerabilities;
  • abuse chat or communication features, including harassment, hate speech, spam or offensive content.
We may, at our sole discretion, restrict or terminate access to the Application in case of suspected cheating, abuse or violations of these Terms.
6. Third-Party ServicesThe Application uses third-party services for analytics, advertising, push notifications and crash reporting, including but not limited to:
  • Google Firebase (database, analytics)
  • Google Analytics for Firebase / Google Analytics
  • Tenjin
  • Smartlook (session recording and analytics)
  • Apple Push Notification service (APNs)
  • Advertising networks: Google Ads, Chartboost, Unity Ads, Liftoff Monetize, AppLovin, IronSource

7. Availability and Changes to the ApplicationWe may modify, update, limit or discontinue the Application or any of its features at any time, with or without notice, including:
  • game balance changes;
  • virtual currency prices;
  • availability of certain modes, events or items.
We are not liable for any loss of progress, virtual currency or items caused by technical issues, necessary maintenance, updates or other changes, except where required by applicable law.
8. Limitation of LiabilityTo the maximum extent permitted by law, the Application is provided “as is” and “as available”, without warranties of any kind, either express or implied.
We are not liable for:
  • any indirect, incidental, special or consequential damages;
  • loss of data, virtual currency, in-game progress or profits;
  • issues caused by your device, internet connection, App Store platform or third-party services.
Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.
9. TerminationWe may suspend or terminate your access to the Application at any time if you violate these Terms or applicable law. You may stop using and uninstall the Application at any time.
Upon termination:
  • your license to use the Application will cease;
  • you may lose access to your account, progress and virtual items, without compensation.
10. Changes to These TermsWe may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. Continued use of the Application after changes means you accept the updated Terms.
